Unjust Land Confiscation in the Central Highlands:

The indigenous people in the Central Highlands are facing immense pain due to the arbitrary land confiscation by the authorities without proper notification.

On April 3, 2023, dozens of police officers in civilian and uniform attire entered the garden of the residents in Buon Drao, Cu Ne commune, Krong Buk district, Dak Lak province to measure the land in order to forcibly seize it for some unclear purpose. The local government has not issued any decision to notify the residents of the land confiscation.

The unilateral action of the district and provincial police has caused great anger and opposition among the people. In this article, we argue that this land confiscation violates the Land Law 2013 and demand that the local authorities reconsider the legality of their actions.

Procedures for Land Recovery:

According to the Land Law 2013, the procedures for land recovery for national defense, security; economic and social development for national and public interests must be followed.

These procedures include the development and implementation of plans for land recovery, investigation, survey, measurement, and verification. Additionally, the competent People’s Committee that is authorized to recover land issues a notice of land recovery.

Violation of Land Law 2013:

The actions of the district and provincial police in unilaterally carrying out land measurement without consulting the residents violate the Land Law 2013. The law clearly states that the notice of land recovery must be sent to each person whose land is to be recovered, disseminated to the residents in the area where the land is to be recovered, and posted on public information media, and displayed at the headquarters of the commune-level People’s Committee, and the common living area of the residential area where the land is to be recovered. The lack of proper notification to the residents of the land confiscation is a clear violation of the Land Law 2013.

Conclusion:

The actions of the district and provincial police in unilaterally carrying out land measurement without consulting the residents violate the Land Law 2013. The law clearly states that the notice of land recovery must be sent to each person whose land is to be recovered, disseminated to the residents in the area where the land is to be recovered, and posted on public information media, and displayed at the headquarters of the commune-level People’s Committee, and the common living area of the residential area where the land is to be recovered.
